The U.S. Court of Appeals at the First Circuit level dismissed an appeal made by animal rights organizations in regards to the incidental trapping of Canada lynx.

The lawsuit was initiated by animal rights groups who hoped the verdict this time around (the activists had failed to ban the trapping of the cat earlier this year) would remove Incidental Take Permits (ITP), which allows trappers to avoid prosecution for inadvertently trapping a lynx during the course of lawful trapping. The Canada lynx has been listed as “threatened” under the Endangered Species Act since 2000.

The dismissal allows trappers in Maine to continue obtaining Incidental Take Permits (ITP) for lynx.
